This page describes the terms and conditions (the “Terms of Use”) that apply to the use of the Fabry Indicator application (the “Application”) which is made available through the website www.fabryfind.eu (the “Site”). The Application is a Class I medical device and has been developed by Genzyme Europe B.V. (“Sanofi Genzyme”, “we” or “us”), an affiliate of the French parent company Sanofi SA.
We have contracted the company Iguazu Limited (“Iguazu”) to host the Site and manage the Application on our behalf. Advance Medical may involve third parties to perform certain tasks for the hosting of the Site and the management of the Application.
By using the Application you undertake to comply with these Terms of Use without reservation. If you do not agree to these Terms of Use, please refrain from using the Application. We advise you to consult these Terms of Use regularly, as they may be modified from time to time and without notice. The date of the last up-date is indicated above.
The Application is intended for use by health professionals practising in Iraq. It is a web based application for the creation of pedigree charts to help predict whether a family members of a confirmed diagnosed Fabry disease patient are is at risk of having Fabry disease as well (“Pedigree Charts”). Its purpose is to assist, not replace, clinical judgment. Fabry disease can only be confirmed through the appropriate genetic testing).
The Application is provided exclusively for your own personal professional use. It can only be accessed and used following registration and creation of a personal account. Enabling other individuals to use the Application with your account details is not allowed.
You can browse the Application. You can print the elements of the Application. You can use and download any information contained or generated by the Application for your own professional use. You cannot use any of the elements of the Application for other purposes, including public or commercial uses, without having received prior written consent of Sanofi Genzyme.
You are responsible for ensuring that the data which you enter into a Pedigree Chart, such as the name and gender of the family members, is accurate and complete.
As this involves (sensitive) personal data, we like to remind you of your responsibility for ensuring that such data is collected and processed in accordance with applicable data protection legislation.
The data that you enter into a Pedigree Chart will only be stored on your computer / device and cannot be accessed by Iguazu or Sanofi Genzyme. Iguaza does collect and store information about the number of nodes included in each Pedigree Chart and the colour of each node for the purpose of generating the statistics that are provided within the Application.
Collection and processing of your personal data by Iguazu
When you decide to use the Application, Iguazu will collect and process certain information about you and your usage of the Application which is personal data within the meaning of applicable data protection legislation. More specifically, this concerns the following information:

The Application and all intellectual property rights associated therewith, such as author’s rights, copyrights, patents, trademarks, sui generis rights relating to databases, designs, logos, know-how and all other intellectual property rights (whether registered or not) contained in this Application are protected by applicable laws on intellectual property. They are owned by Sanofi Genzyme or its affiliated companies, or belong to third-parties and are used by Sanofi Genzyme pursuant to an authorization of use granted by their owner.
Sanofi Genzyme hereby grants you a limited, non-exclusive, non-transferable, personal and complimentary license to access and use the Application in accordance with the provisions of these Terms of Use. Any other use of the Application is strictly prohibited.
Your use of the Application is at your own risk. The Application is provided “as is”, without representation or warranties of any kind, either expressly or implied, including without limitation with respect to quality, fitness for a particular purpose, accuracy, title or non-infringement.
Although Sanofi Genzyme will make all reasonable efforts to ensure the correct functioning of the Application, we cannot make any guarantees in that respect.
With the exception of direct damages resulting from wilful misconduct or gross negligence by Sanofi Genzyme, Sanofi Genzyme declines liability for:
You acknowledge (i) that it is technically impossible for the Application to be free from defects and that Sanofi Genzyme does not undertake any responsibility for this; (ii) that the Application may be at certain times temporarily unavailable; and (iii) that the operation of the Application may be adversely affected by events and/or matters outside the control of Sanofi Genzyme, for example, transmission and telecommunication methods.
Sanofi Genzyme and/or its suppliers may, at any time, temporarily or permanently, modify or interrupt all or part of the Application in order to perform maintenance work and/or make improvements and/or changes to the Application. Sanofi Genzyme does not assume any responsibility for any modification to, or suspension or interruption of the Application.
Sanofi Genzyme reserves the right to no longer make the Application available, either temporarily or permanently, at any time and for any reason.

These Terms of Use and your use of the Application are governed by the laws of Iraq. Disputes arising from or related to your use of the Application shall be exclusively brought before the district court in the Capital city of Iraq.
